Identify Act offence discontinued after representations by Sallie Bennett-Jenkins KC in court
Sallie Bennett-Jenkins KC was instructed to represent a foreign National who was also entitled to a second passport.
The client was due to be taken on a short break to a European country by her fiancée, who had booked the break as a surprise and had used the details of the second passport; this was offered to the check in agent and on examination was said to have a number of significant defects in the biometric data. These would only be identifiable through magnification and specific testing.
At the time of travel, the client also had in her possession her valid principal passport.
Sallie Bennett-Jenkins KC set out the nature of the representations before the Magistrates Court at the first appearance. Following the hearing, a notice of discontinuance was sent to the instructing solicitors.
