Driver cleared by jury in tragic double fatality case, Michael Rawlinson defending

A driver who was involved in a tragic accident which claimed the lives of two motorcyclists has been cleared of causing their deaths by careless driving. He was represented at trial by Michael Rawlinson of 2 Hare Court.

The jury took just 1 hour and 20 minutes to reach unanimous not guilty verdicts in the case of Stuart Robinson, heard at Southampton Crown Court over six days.

The prosecution alleged that the defendant had improperly failed to stop and make sufficient checks when emerging into the A326 Marchwood Bypass.

During Michael’s cross-examination of the Crown’s Forensic Collison Investigator, it was established that the motorcycles may have been travelling at up to 75mph in a 40mph zone, and may have also been actually out of view when the defendant made his checks.

Michael was instructed by Naomi North from Kennedys Solicitors and assisted by the defence Forensic Collision Investigator, Pete Davey from Viewpoint Investigative Services.

Michael is member of chambers’ Criminal Team and specialises in the defence of high-profile and private/insurance-funded fatal road traffic offences.
