The nurse in question faced allegations of dishonesty, failing to adhere to prescribing protocols, failing to return a prescription pad upon leaving employment, and subsequently using that pad to prescribe for family and friends. The hearing, part heard from 2022, lasted two weeks. The nurse admitted many of the allegations, but not those alleging dishonesty. Submissions of no case to answer on these charges were unsuccessful. At the end of the facts stage of the proceedings, the Panel found only one of the dishonesty charges proven. The Panel subsequently found misconduct in relation to five charges spanning five months, including the dishonesty charge, and that the nurse’s fitness to practise was impaired. The NMC sought a strike-off. Jack successfully argued that the nurse should be allowed to continue practising without any restriction, and that the regulator’s submission was disproportionate. The Panel decided to impose a caution order for five years.


Jack represented a social worker facing two charges; namely, that he had sent inappropriate messages via a private messaging platform to a friend, and that he had harassed his former manager over a period of some months. The social worker of around ten years’ experience had never been the subject of disciplinary proceedings before. At the hearing, the Panel determined that, although the messages reflected badly on the social worker, they did not fall within the scope of the social worker’s professional practice, and they did not serve to lower the reputation of the profession. They did not amount to misconduct. Although misconduct was found in relation to the second charge (harassment), the Panel acceded to submissions that the behaviour was out-of-character, remediated, and at such low risk of repetition that a finding of impairment in the public interest was unnecessary.
