During the course of engineering works in the vicinity of high-voltage overhead power lines (OHPL), an employee suffered fatal injuries when the MEWP he was operating came into contact with 11kV OHPL. The HSE alleged that the defendant had failed to adequately plan the work and had operated to flawed systems of work. The defendant was a sub-contractor of BT Openreach and maintained that in following BT proscribed procedures, it had done all that was reasonably practicable to avoid exposure to danger.
