Travis Perkins Trading Company Limited was fined £2 million in relation to a prosecution arising out of an incident on the A26 in East Sussex when a load comprising lengths of timber which had not been properly secured fell from the side of a Travis Perkins lorry into the path of oncoming traffic. Tragically, one of the lengths pierced the windscreen of a BMW, killing the driver instantly.
The company pleaded guilty to three offences contrary to the Health and Safety at Work Etc Act 1974 relating to the inadequate training of staff and consequent failures to ensure proper procedures were in place and being followed for load security.
