Detailed analysis and representations lead to prosecution offering no evidence
Sallie Bennett-Jenkins KC represented her client in a case involving multiple allegations of occasioning actual bodily harm and strangulation. The allegations arose against a background of acrimonious divorce and financial proceedings. Sallie advised on the instruction of a pathologist and a psychiatrist, both of whose reports were served on the prosecution together with a large volume of material that would be the subject of applications for the admission of the complainant’s bad character. Comprehensive and detailed letters of representation, together with later served evidence which assisted the defence, compelled the prosecution to offer no evidence. Consideration is being given to whether an application for wasted costs can be made against the prosecution.
