Brian O’Neill KC represents NTL in fare evasion cases
Brian O’Neill KC appeared before Westminster Magistrates’ Court on behalf of Northern Trains Limited [NTL] in respect of a series of prosecutions of alleged fare evaders who were prosecuted in a manner which was procedurally incorrect and which proceedings were, therefore, a nullity.
Addressing The Chief Magistrate, Mr O’Neill KC told the court that it was accepted by NTL that it had no power to use the Single Justice Procedure to bring a prosecution under either s.5(1) or s.5(3) of the Railway Regulations Act 1889.
Mr O’Neill KC also told the court that NTL wished to apologise to the court and all interested parties for having fallen into error in the exercise of its prosecutorial powers, that it had co-operated fully with the court’s review and that it will continue to do so.
