Michael Rawlinson secures reinstatement of Police Sergeant at Police Appeals Tribunal hearing

Michael Rawlinson has secured the reinstatement of a Police Sergeant at a Police Appeals Tribunal hearing held in August 2019.

The Appellant, a Sergeant from the Nottinghamshire Constabulary, had originally been dismissed for gross misconduct at a police disciplinary hearing. This followed various allegations, including the alleged misrepresentation of his powers of entry and the use of force in affecting a subsequent arrest.

On appeal, the Tribunal accepted Michael’s submissions that the original panel had fallen into error in terms of the inappropriate, hostile and protracted questioning of the Sergeant by one of the panel members  at the original hearing.

The officer was reinstated and the case has been remitted for fresh consideration at a rehearing.
