Michael Rawlinson Secures Reinstatement of PC Following Police Appeals Tribunal Hearing

Michael Rawlinson has successfully represented a Police Constable at a Police Appeals Tribunal hearing held in March 2019.

The officer had originally been dismissed for gross misconduct at a police disciplinary hearing. This followed allegations that he had given false details to security staff investigating an allegation of shop theft, and associated findings regarding his honesty and integrity.

The Tribunal accepted submissions that the original panel had fallen into error in terms of taking into account irrelevant matters, and also in failing to apply the correct definition of “Gross Misconduct” for the purposes of the Police (Conduct) Regulations 2012.

The officer was reinstated and the case has been remitted for fresh consideration at a rehearing.
