Success for Sallie Bennett-Jenkins in a disclosure battle with CPS in Victims Right to Review case together with an apology from the CPS for her client

The CPS offered no evidence against AZ, a man of good character accused of attempted rape and assault by penetration.

The proceedings against him had been discontinued in 2011 and he has been told no further action would follow.

However proceedings were reinstated in 2015 under the Victims Right to Review.

Abuse of process was raised from the outset and dogged determination in pursuing disclosure finally led to an admission by the CPS that their process had been subject to “inexcusable failures” and that a fair trial was not possible.

The crown also accepted that the privately funded costs sought as costs against the CPS would not be challenged.
