Chris Gillespie, instructed by Ian Barker of the MDU, persuaded the CPS and Court to withdraw a PACE warrant requiring a GP to produce to the police the medical records of a patient whom the police were investigating on the basis that PACE does not give the police power to seize medical records and that any such warrant would be unlawful. Anecdotally it appears that such warrants are regularly applied for and granted because medical practitioners do not think to challenge them.
