Christopher Geering successfully appealed the GMC’s decision to erase a doctor from the register this week.

The panel had prevented the doctor from adducing new evidence after it had sent out a draft factual determination, but before the decision had been formally announced. It reasoned that the factual stage of proceedings was closed and it had no jurisdiction to reopen it. The High Court disagreed with this interpretation of the rules. The new evidence cast doubt on the factual conclusions provisionally reached by the panel and, in those circumstances, the case had to be remitted back for a re-hearing.
