Criminal Regulatory

Last year, Robert undertook a three-month secondment at the Environment Agency as external counsel. He appeared on behalf of the Agency in the Magistrates’ and Crown Courts, and was involved in prosecution casework across a broad range of environmental offences. He developed a detailed knowledge of environmental law, and of Environment Agency prosecutions.

Following his time at the Environment Agency, he has been instructed for the defence in a number of cases involving a range of environmental offences, from pollution to waste. Having prosecuted these matters, he is well placed to advise on strategy and approach in responding to cases brought by the Agency.

Robert has also given seminars and written articles on developments in Health and Safety Law. Last year he spoke at the 2 Hare Court Health and Safety Seminar about the new Construction (Design and Manufacturing) Regulations. This year he spoke about recent changes in the law surrounding prohibition notices.

Cases

United Utilities -v- JEM

 Advised and represented a company faced with 5 offences under the Water Industry Act 1991. The case involved complex and conflicting expert evidence in relation to the risk of environmental harm.

Environment Agency -v- J

 Instructed to defend in an Environment Agency prosecution under the Environmental Permitting Regulations 2010.

Environment Agency -v- M

 Instructed to prosecute an individual on behalf of the Environment Agency for pollution offences.
