Emily Dummett

Called to the Bar in November 2006, Emily was invited to join 2 Hare Court in April 2008 after the successful completion of an eighteen month pupillage in Chambers. Although her experience is predominantly based in the criminal law, the skills she has acquired as a criminal advocate have allowed her successfully to extend her practice into a range of other areas.

In addition to her advocacy work, Emily also regularly accepts instructions to advise on discrete points of law in both criminal and civil matters. Unusually for a criminal barrister at her level of call, she has significant experience of civil matters in the High Court. She has successfully conducted applications for injunctions in support of the criminal law, and for the disclosure of documents lodged in civil proceedings, where those documents have a bearing on ongoing or contemplated criminal proceedings. Emily has a particular interest in the crossover of the criminal and civil law, and is well-placed to advise on the practical implications of this tension. She also has a particular interest in the crossover of criminal and public law.

Crime

Emily is a Grade 3 CPS Prosecutor, and has also been appointed to the Serious Fraud Office's ‘C' List of advocates. She is regularly instructed to prosecute trials, including in multi-handed cases and those involving serious violence. She has significant experience as a led junior in serious and complex prosecution work, including CPS Special Casework, Kidnap Unit and Flying Squad prosecutions. As a result, she has an excellent knowledge of the practical application of the principles of disclosure, public interest immunity and the Regulation of Investigatory Powers Act 2000.

She was junior counsel for the first respondent in an appeal to the House of Lords concerning the interpretation of terrorist offences, where the defendant had sought to rely on his mental illness as part of his reasonable excuse (reported at R v G [2010] 1 A.C. 43).

In addition, Emily has a busy defence practice. Recent instructions include cases of multi-handed robbery, blackmail, and wounding with intent. Emily has also successfully appeared for the defence in the Court of Appeal.

Professional Discipline

Emily regularly appears before the General Social Care Council in substantive hearings before the Conduct Committee and interim suspension order applications before the Preliminary Proceedings Committee. She is increasingly instructed to appear before other regulators, too.

Other work

Emily has also been instructed to conduct Extradition hearings, Coroner's Inquest work, and appeals to the Immigration and Appeals Tribunal and the Supreme Court Costs Office. She has written papers to be presented to investigators and instructing solicitors on human trafficking, environmental law and partial defences to murder. She has also provided training in courtroom skills to SOCA lead officers.
