Fiona Robertson Secures Acquittal For Client Charged With GBH After Nightclub Brawl

Two years after the events occurred Fiona Robertson secured an acquittal for her client who was charged with a s.20 GBH following a brawl in a Brighton nightclub. The defendant was accused of launching an unprovoked attack on the victim in which he was alleged to have head butted the victim, thrown him into a DJ booth and kicked him in the head while he lay on the floor. The Crown’s case relied on CCTV footage of the fight and three witnesses who testified they saw the defendant viciously drop kick the victim in the head while he lay on the floor. The victim suffered extensive facial fractures for which he was still receiving treatment two years later.

The defendant accepted head butting the victim but asserted he had done so in self defence. He denied kicking the victim in the head stating he had merely flicked his foot to get the male off him as he was afraid the victim was trying to continue the fight.

After less than an hour of deliberating the jury returned a verdict of not guilty.
